
General Information on Building Control, Planning and
Covenants.
Many members of the public misunderstand the difference
between the above controls, any one of which or all may be required
when you alter or build property. This guidance
has been produced to explain the difference, and hopefully answer
this question in simple terms. If you are still unsure, please
contact the relevant section. It is always advisable to check
before you commence any work.
BUILDING CONTROL
Building
Control deals with the way the building is constructed, for
example structural stability, fire resistance, ventilation, thermal
insulation and so on. The Building Regulations 2000 sets down
minimum standards to safeguard the health and safety of persons in
and around buildings. They are also concerned with conserving fuel
and power and providing facilities for disabled people. Some minor
works are exempt from the requirements and it is always advisable
to check with the Building Control section who may be
contacted on 01279 446859. Working practices on
construction sites will be governed by the Health and Safety Executive.
PLANNING
Planning deals with the
correct use of land, the appearance of the proposed building and
the effect it will have on surrounding properties and environment.
Some domestic work is classed as “Permitted Development” and may
not require consent. Common planning guidelines in respect of

COVENANTS
Covenants are legal agreements
contained in the property transfer documents requiring owners to
obtain approval for alterations and extensions prior to commencing
any work. Most properties in Harlow have Restrictive Covenants on
them, which require the owner to seek consent from the Council
prior to making alterations to their property. This is known as
Covenant Consent and is a separate process from planning consent or
approval under the Building Regulations. This includes all homes
bought under the Government Right-to-Buy Scheme and some private
residential areas, which were built on land owned by the Council or
Development Corporation. The Council does not administer covenants
on Church Langley.
