Planning Enforcement

Harlow Council investigates alleged breaches of planning controls, negotiate resolutions and where necessary carry out enforcement action. Any enforcement action must be proportionate to the breach and justifiable should any appeal against the action be taken. More information on planning enforcement definitions

Enforcement action

There are several different types of enforcement action that can be taken by Harlow Council, those that remain extant to date are listed below:

Enforcement Notices

  1. Plots 4-7 Skins Farm, Roydon Road, Essex (pdf)
    Enforcement Notice served: 27 October 2006
    ​Actions required:
    • Remove the Barrier.
    • Remove the Ballasted Hardstand Area.
    • Remove the Hoggin Surfaced Drives.
    • Remove the Parking Area Remove the Main Parking.
    • Remove the Fences.
    • Remove from the land all building materials and rubble arising from compliance with requirements 5.1-5.6 above.
    • Restore the land to its condition before the above breaches of planning control took place by levelling the ground and re-seeding it with grass.

Outcome: Prosecution action taken. site substantially cleared.

  1. Plots 4-7 Skins Farm, Roydon Road, Essex (pdf)
    Enforcement Notice served: 26 February 2007
    Actions required:
    • Removal of recreational chalet and any other ancillary structure.
    • Restore the land to its original condition by removing all debris from the land and levelling the area on which the recreational chalet and any other ancillary structures were situated and re-seed the area with grass.

Outcome: Prosecution action taken, site substantially cleared.

    Enforcement Notice served: 11 June 2012
    Without planning permission the change of use of the said land to the stationing of a caravan for recreational use.
    ​Actions required:
    • Cease the use of the said land for the stationing of a caravan.
    • Cease any recreational use of the said land.
    • Remove the caravan and all ancillary development associated with the use for the stationing of a caravan for recreational use from the land, including the removal of the hard standing, fencing, water supply and external lighting from the said land.
  2. Plot 13, Ski​ns Lane, Harlow (pdf)
    Enforcement Notice served: 11 June 2012
    Without planning permission the change of use of the said land to the recreational use of a chalet.
    Actions required:
    • Cease the use of the said land for the recreational use of a chalet.
    • Remove the chalet and all ancillary development associated with the recreational use of the chalet, including the removal of the hard standing, fencing, water supply, gates and storage container from said land.

Outcome: Site cleared. Prosecution successful defendant fined £10,000, plus costs. Proceeds of Crime Act Confiscation Order issued.

  1. Plots 14 & 15, Skins Lane, Harlow (pdf)
    Enforcement Notice served: 11 June 2012
    Without planning permission the change of use of the said land to the recreational use of a chalet.
    Actions required:
    • Cease the use of the said land for the recreational use of a chalet.
    • Remove the chalet and all ancillary development associated with the recreational use of the chalet, including the removal of the hard standing, fencing, water supply, gates and storage container from said land.

Outcome: Site cleared. Prosecution successful defendant fined £10,000, plus costs. Proceeds of Crime Act Confiscation Order issued.

    Enforcement Notice served 5 December 2013
    ​Action required:
    • The balcony/terrace platform, railings and associated materials should be completely and permanently removed from the 2nd floor rear elevation of the dwelling house, and the brick façade should be made good in order to match the existing material of the rear elevation.

Outcome: Appeal dismissed. Compliance required.

    Enforcement Notice served: 29 May 2014
    ​Action required:

    Outcome: Appeal pending.

    • Remove the building and decking from the Land
    • Removed from the Land all building materials and rubble arising from compliance with the step 1 and restore the land to the its condition before the breach took place.

  2. Plot 17, Harlow Business Park, Roydon Road, Harlow (pdf)
    Enforcement Notice served: 8 August 2014
    Without planning permission (1) the construction of a reinforced concrete surface and a tank with a concrete retaining wall on and under the Land (2) the erection of a portakabin and a breeze-block hut on the Land in the approximate position and extent as shown on the unauthorised development plan (pdf).
    ​Action required:
    • Remove the concrete hard surface, tank and concrete retaining wall around the tank from the said Land (Step I.)
    • Remove from the Land the portakabin building and breeze block hut (Step II.)
    • Remove from the Land all building materials, rubble and debris arising from compliance with Step I. and Step II. above, and restore the Land to its condition before the breach took place.

Outcome: Appeal pending.

  1. 263 Northbrooks, Harlow (pdf)
    Enforcement Notice served: 9 March 2015
    Without planning permission, the sub-division of the site into two flats.
    ​Action required:
    • Cease the use if the Property as two residential flats
    • Remove from the Property all items, materials and debris associated with the unauthorised use, including:
      • the external doorway at point A on the attached floor plan of the Property marked 'Plan B' ('Plan B')
      • ​the internal dividing wall between points B and C on Plan B.
      • the ground floor bathroom
      • the first floor kitchen
    • Restore the Property to its condition before the breach took place.

  1. 21 Vicarage Wood, Harlow (pdf)
    Enforcement Notice served: 25 August 2015
    Without planning permission, the erection of a single storey front extension:
    ​Action required:
    • Demolish the single storey front extension
    • Remove from the land to which this notice relates all materials, debris and other paraphernalia which results from complying with step one (1).

Outcome: Appeal pending.

  1. Land at 17 Old Orchard Harlow (pdf)
    Enforcement Notice served: 25 August 2015
    Without planning permission, the erection of a single storey front extension:
    ​Action required: Remove the temporary building shown in the approximate location hatched blue on the plan attached to this Notice.
    • Demolish the single storey front extension
    • Remove the temporary building shown in the approximate location;
    • Remove from the land to which this notice relates all materials, debris and other paraphernalia which results from complying with step one (1)

Breach of Condition Notices:

  1. 50 Denby Grange, Harlow (pdf)
    Breach of Condition Notice served on 2 May 2012
    Breach of Condition 9 of Planning Permission HLW/96/0185
    Unauthorised boundary wall to the front and side of the property
    ​Required Action:
    • Remove the small and dwarf wall erected to the northern boundary of the property as annotated on the attached plan.
    • Re-instate a 600mm high post and rail fence to the northern boundary of the property, replacing the annotated small wall.

Outcome: Prosecution action taken, compliance now occurred.

    Breach of Condition Notice served on 16 May 2012
    Breach of Conditions 2, 5, 6 and 8 of Planning permission HW/PL/11/00121
    ​Required Action:
    • No further work or operations are/is to be carried out at the site until all the conditions outlined in paragraph 4 (of the Breach of Condition Notice) have been regularised and dealt with in a manner agreeable to the Local Planning Authority
    • Submit to the Local Planning Authority for its approval a detailed site survey including existing ground levels and existing trees, hedgerows, water courses and footpaths and a plan showing details of the proposed planting and structural landscaping to the site, as required by condition 2.
    • Submit to the Local Planning Authority for its approval a plan showing the proposed materials and extent of the hard surfaced areas, details and siting of all external lighting, and details of the perimeter security fencing or proposed boundary treatments to be erected on the site, as required by condition 5.
    • Submit to the Local Planning Authority for its approval detailed plans showing the layout, provision and disposal of foul and surface water drainage, including details of connections to the main drainage systems, as required by condition 6.
    • Submit to the Local Planning Authority for its approval a surface water drainage scheme for the site, as required by condition 8.

Outcome: Prosecution action taken, compliance outstanding.

    Breach of Condition Notice served on 10 April 2014
    Breach of Condition 4 of Planning Permission HW/PL/11/00121
    ​Required Action:
    • Cease all commercial and industrial activities at the site (including the operation of engines of any coaches and buses parked at the site and associated with the Coach Park/depot) and any maintenance and repair outside the permitted hours specified within condition 4.

Outcome: Withdrawn.

    Breach of Condition 4 of Planning Permission HW/PL/11/00121
    ​Required Action:
    • Cease the running of engines of any passenger carrying vehicles (i.e. coaches and buses) at the site and associated with the coach park/depot (except when the vehicles are being moved onto the site to park) outside the permitted hours specified within condition 4.  This includes the running of engines in association with the carrying out of any daily checks that may be necessary before passenger carrying vehicles parked at the site are brought into use to undertake commercial passenger transport services.

Outcome: High Court challenge failed. Court of Appeal Pending.

    Breach of Condition 1
    Required Action:
    • Remove the chalet, ancillary structures and fencing from said land.
    • Reinstate the said land to its original condition, namely a grass meadow with a 1.5m high post and rail fence along the northern and eastern perimeter.

Outcome: Site cleared.

    Required Action:

    • Outcome: Compliance occurred.
  4. Newhall Phase 2, Parcel 1 – Linden Homes/Moat Homes Development (pdf)
    Breach of Condition Notice served on 3 September 2014

    1 - Breach of Conditions 3, 4, 13 and 23 of HW/Pl/04/00302
    2 - Breach of Condition 12 of HW/PL/13/00098 and HW/PL/13/00100
    Required Action:

    1. Breach of Conditions 3, 4, 13 and 23 of HW/Pl/04/00302

      • Remove the small dwarf wall and gate erected adjacent to the western gable wall of No. 50 Denby Grange between No. 50 and No. 51 Denby Grange.
      • Submit a condition discharge application in respect of Condition 23, detailing the measures to be implemented across the development to achieve at least a 10% energy consumption reduction across the site from de-centralised and renewable or low carbon sources.
      • Submit a schedule of any rectification works necessary to install energy saving measures to the dwellings already constructed on site and a timetable for the completion of such works.
      • Obtain Technical Approval from Essex County Council Highways Team to the highway works proposed for the entire Parcel 1 site.
      • Submit appropriate and valid condition discharge applications and obtain approval for details pertaining to Condition 3, 4 and 13.
      • Submit a schedule of any rectification works required to take place, following receipt of Technical Approval, to estate roads, footways, pedestrian protection measures, other circulation areas and any hard landscaping that has been implemented and a timetable for the completion of any such works.
    • Outcome: Compliance occurred.

    1. Breach of Condition 12 of HW/PL/13/00098 and HW/PL/13/00100
      • Obtain Technical Approval from Essex County Council Highways Team to the highway works proposed for the entire Parcel 1 site.
      • Submit appropriate and valid condition discharge applications and obtain approval for details of the estate roads and footways (including layout, levels, gradients, surfacing and means of surface water drainage).
      • Submit a schedule of any rectification works required to take place, following receipt of Technical Approval, to estate roads and footways that have been implemented and a timetable for the completion of any such works.
    • Period for Compliance: 60 days from service.

  1. Land Adjacent No. 1 Churchgate Street (pdf)

    • Cease all construction work on site on Sundays and Public Holidays.
