A representation is a formal submission either supporting or objecting to a licensing application. We can only consider representations that relate to the licensing objectives and meet the requirements of the Licensing Act 2003.
If we receive an application for a new premises licence, a variation to an existing licence or to review a licence we will advertise this on our Licensing Hub page on Let's Talk Harlow.
There is a 28 day consultation period for representations, except for minor variation applications, which have a 10 day period.
Representations can be made by:
- a person living in Harlow who is likely to be affected by the licence
- a person involved in a business in Harlow who is likely to be affected by the licence
- a responsible body
Make sure your representation is valid
In order for your representation to be valid, it must relate to one of the 4 licensing objectives, which are:
- the prevention of crime and disorder
- public safety
- the prevention of public nuisance
- the protection of children from harm
It also has to:
- be submitted within the consultation period
- not be frivolous or vexatious
- not be repetitious
- be submitted in writing and include your name and address
- be relevant to the application in question
We can reject representations that we consider to be frivolous or vexatious.
A frivolous representation is one that lacks seriousness or does not raise a genuine issue relevant to the licensing objectives.
A vexatious representation is one that is made primarily to cause annoyance, disruption, or delay, rather than to address a legitimate concern.
Make a representation
You can make a representation by completing the online form for the relevant notice on Let's Talk Harlow's Licensing Hub.
Once we have received your representation, if the issue cannot be resolved with the applicant, we will take the application to a licensing subcommittee for councillors to consider.
If you are unhappy about a decision of the subcommittee and you made a relevant representation, you can appeal the decision to the magistrates court.
